5. How the record satisfies number 4
  The portions of the records for which WPL is requesting confidential treatment are classified as confidential under various agreements executed between WPL (or its affiliates) and its tax equity partner. In addition, the information subject to this request includes contractual terms that WPL negotiated with the tax equity investor for several of WPL’s solar projects. Public disclosure of this information would harm WPL by resulting in the release of competitively sensitive information related to the tax equity transaction, which could be used by WPL’s competitors to WPL’s detriment and could make it more difficult for WPL to negotiate favorable commercial terms with potential future tax equity investors. Accordingly, pursuant to PSC 2.12, sections 19.36(5) and 196.14, 134.90(1)(c) Wis Stats., and public policy supporting confidential treatment of records as outlined in State ex rel. Youmans v. Owen, 28 Wis 2d 672, 137 N.W.2d 470 (1965), WPL requests that this information be handled confidentially.
